Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Tally mobile application (the "App") operated by Tally ("we," "our," or "us"). Please read these Terms carefully.

By accessing and using this nutrition and meal planning application, you accept and agree to be bound by the terms and provisions of this agreement. If you do not agree to abide by the above, please do not use this service.

To use the App, you must create an account using a valid email address, Google Sign-In, or Sign in with Apple. You must be at least 16 years of age to create an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete. You are solely responsible for safeguarding your account credentials.

5. AI-Powered Features & Limitations

The App uses artificial intelligence (Google Gemini) to analyze food images, estimate nutritional content, and provide personalized nutrition guidance through Jasmine, our AI chat assistant. AI-generated results are estimates only and may not be 100% accurate. Nutritional values are approximations based on visual analysis and external food databases (USDA FoodData Central, Open Food Facts) and may vary from actual values. Jasmine provides general wellness guidance and is not a licensed dietitian, nutritionist, or medical professional. You should independently verify any AI-generated nutritional information before making dietary decisions, especially if you have food allergies, medical conditions, or specific dietary requirements. Halal classification provided by the App is best-effort and should be independently verified for compliance with your religious requirements.

THE APP IS NOT INTENDED TO DIAGNOSE, TREAT, CURE, OR PREVENT ANY DISEASE OR MEDICAL CONDITION. All health-related features, including nutrition tracking, meal planning, biometric monitoring, and AI recommendations, are provided for informational and wellness purposes only. They are not substitutes for professional medical advice, diagnosis, or treatment. Always consult your physician or a qualified healthcare provider before starting any diet, exercise program, or nutrition plan, particularly if you have pre-existing medical conditions, take medications, are pregnant or nursing, or have a history of eating disorders. If you experience any adverse health effects while using the App, discontinue use immediately and consult a healthcare professional.

7. Intellectual Property

All content, features, and functionality of the App, including but not limited to text, graphics, logos, icons, images, software, AI models and algorithms, nutritional databases, meal plan templates, and the overall design and compilation thereof, are the exclusive property of Tally and its licensors and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes.

8. User-Generated Content

You retain ownership of any content you submit through the App, including food photos, profile information, and health data. By submitting content, you grant us a non-exclusive, worldwide, royalty-free license to use, process, and store such content solely for the purpose of providing and improving the App's services. Food images you upload are processed by our AI systems to provide nutritional analysis and are stored in our cloud infrastructure. You represent that you have the right to submit any content you provide and that such content does not violate any third party's rights.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL TALLY, ITS AFFILIATES, OR ITS LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM: (A) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE APP; (B) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE APP; (C) ANY CONTENT OBTAINED FROM THE APP, INCLUDING AI-GENERATED NUTRITIONAL ESTIMATES; OR (D) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR DATA.

We do not guarantee the accuracy of nutritional information, AI analyses, or meal plan recommendations. You use such information at your own risk.

11. Termination & Account Deletion

We may terminate or suspend your account and access to the App immediately, without prior notice or liability, for any reason, including but not limited to a breach of these Terms. Upon termination, your right to use the App will immediately cease.

You may delete your account at any time from within the App via Settings → Account → Delete Account. Upon account deletion, we will delete or anonymize your personal data in accordance with our Privacy Policy, except where retention is required by law.

12. Changes to Terms

We reserve the right to modify or replace these Terms at any time at our sole discretion. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect, via in-app notification or email. What constitutes a material change will be determined at our sole discretion. By continuing to access or use the App after those revisions become effective, you agree to be bound by the revised terms.

13. Governing Law

These Terms shall be governed and construed in accordance with the laws of Egypt, without regard to conflict of law provisions. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the competent courts of Egypt. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will remain in effect.
